When Custody Is Contested

Sometimes, couples simply cannot come to an agreement on issues, and nowhere is this more common than in discussing child custody. While custody decisions do not have to be contentious, they often become intense or even hostile. In such cases, the court will be involved, both to ensure that a fair decision is made and to try and protect the children.

Factors Deciding Custody

Nevada law requires courts to investigate numerous factors in determining an Order for child custody, with some carrying greater weight than others. Some of the factors a Nevada court will consider:

  • The wishes of the child, if they are old enough and mature enough to form a reasonable opinion;
  • The ability of each parent to provide for the child’s physical, emotional and mental health;
  • Any history of abuse, neglect or abduction on the part of either parent;
  • Any history of domestic violence against anyone (not only against the child);
  • The level of conflict between the parents and the likelihood of the child being able to maintain a relationship with both parents; and
  • The mental, physical and emotional health of both parents.
